This Privacy Statement discloses the privacy practices for www.cybershift.com (the "Site"). CyberShift, Inc. ("CyberShift") respects your privacy and is committed to protecting the information that you provide to us. In that regard, we have prepared this Privacy Statement to disclose and describe the information gathering and dissemination practices for the Site. By using the Site, you consent to the collection and use of your personal information by CyberShift as explained below. Please note that CyberShift reserves the right to review and update this Privacy Statement from time to time as needed without notice. Therefore, you should review the terms of this statement each time you use the Site to make sure that you are aware of how CyberShift collects and uses Personal Data. If you use the Site after the amended Privacy Statement has been posted, you will be deemed to have agreed to the amended Privacy Statement.
Privacy Statement; Consent. This Privacy Statement is provided to tell you about CyberShift’s policy regarding the collection, use, and disclosure of Personal Data provided via the Site. The Site is governed solely by applicable Federal and State laws and governmental regulations in the United States. Use of the Site constitutes your consent to application of such laws and regulations and this Privacy Statement. Please review this Privacy Statement carefully before submitting any Personal Data. This Privacy Statement only applies to information provided online. All capitalized terms not defined in this Privacy Statement shall have the meaning assigned to them in the Terms of Use. CyberShift reserves the right to amend this Privacy Statement at any time and from time to time. You should check the Privacy Statement each time you use the Site to determine if any changes have been made. If you use the Site after the amended Privacy Statement has been posted, you will be deemed to have agreed to the amended Privacy Statement.
About Children. CyberShift will not knowingly collect Personal Data from children under the age of 13 through this Site, which is not intended for this age group.
Data Collection and Use. We collect Personal Data that you voluntarily provide through the Site, such as when you contact us with inquiries or use certain CyberShift services. When you contact us, we may keep a record of that correspondence. By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Statement. If you provide Personal Data to the Site, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of CyberShift and any identified third parties.
In order to use portions of the Site or receive information and/or Services, you may have to complete a registration form. During registration, you are required to give your contact information (such as name and email address). This information is used to contact you about the products and/or Services on the Site for which you have expressed interest. It is optional for you to provide demographic information (such as referrer origin and product interest), and unique identifiers (such as country of residence), but encouraged so we can provide a more personalized experience on the Site.
If you opt to provide us Personal Data, we also may use it for purposes such as verifying your identity, sending you information or contacting you. It is our intent to inform you before we collect Personal Data and tell you what we intend to do with it. You will have the option of not providing Personal Data, in which case you may not be able to access certain other portions of the Site or receive certain Services. In certain portions of the Site, we may also enable you to "opt out" of certain uses of your Personal Data, or elect not to receive future communications from us.
When you interact with CyberShift through the Site, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. CyberShift may store such information itself or it may be included in databases owned and maintained by CyberShift, or its affiliates, agents or service providers. The Site may use such information and pool it with other information to track, for example, the total number of visitors to the Site, the number of visitors to each page of the Site, and the domain names of visitors' Internet service providers. It is important to note that no Personal Data is available or used in this process.
CyberShift collects domain information from your visit to customize and improve your experience on the Site. Portions of the Site use "cookies" to keep track of your visit, or to deliver content specific to your interests. A "Cookie" is a small piece of data transferred to your browser and read by the Web server that placed it there. It works as a type of identification card, recording your preferences and previously entered information. You can set your browser to notify you when you receive a cookie, giving you the chance to accept or reject it. Once the user closes their browser, the cookie simply terminates. For instance, by setting a cookie on the Site, the user would not have to log in a password more than once, if required, thereby saving time while on the Site. If a user rejects the cookie, they may still use the Site, however, the user may be limited in some areas of the Site. On most web browsers, you will find a "help" section on the toolbar. Please refer to this section for information on how to receive notification when you are receiving a new cookie and how to turn cookies off.
In an ongoing effort to better understand and serve the users of the Site, CyberShift may conduct research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and CyberShift may share this aggregate data with our affiliates, agents and business partners. This aggregate information does not identify you personally. We may also disclose aggregated user statistics in order to describe our products and/or services to current and prospective business partners, and to other third parties for other lawful purposes.
In general, you can visit the Site without identifying yourself or revealing any personal information. You may also request information about a product or service that CyberShift offers, which may require that a CyberShift representative contact you. Should this occur, any and all information collected on the Site will be kept strictly confidential and will not be sold, reused, rented, disclosed, or loaned to any third party for any purpose whatsoever, including marketing and promotion, and will be used by us only for the time period in which we need to process your request, or to service and support your organization. If you elect to stop receiving electronic correspondence from CyberShift, you will not receive electronic correspondence again unless you specifically ask to be contacted again. Any and all correspondence initiated by CyberShift to process a request made by a client or prospect, or to service and support a client or prospect's account, will be deemed Relationship Messages, as defined by federal law in Section 3(17)(A)(v) of the CAN-SPAM Act of 2003.
There are, however, certain circumstances in which we may share your Personal Data with certain third parties without further notice to you, as set forth below:
- Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate or asset sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.
- Agents, Consultants and Related Third Parties: CyberShift, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples include mailing information, maintaining databases and processing payments. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.
- Legal Requirements: CyberShift may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of CyberShift, (iii) act in urgent circumstances to protect the personal safety of users of the Site or the public, or (iv) protect against legal liability.
Data Security. CyberShift takes reasonable steps to protect the Personal Data provided via the Site from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from the Site may not be secure. Therefore, you should therefore take special care in deciding what information you send to us via e-mail. Please keep this in mind when disclosing any Personal Data to CyberShift or any other party via the Internet.
Data Quality Access, Links. CyberShift strives to keep your Personal Data accurate, complete and current. We will promptly take steps to correct any inaccuracies in your Personal Data after you provide us with written notice of such inaccuracy. This Privacy Statement applies only to the Site. This Site may frame or contain references or links to other web sites not operated or controlled by CyberShift (the "Third Party Sites"). The policies and procedures described in this Privacy Statement do not apply to the Third Party Sites. We suggest that you review the privacy statements and policies of each Third Party Site that you visit.
